Which role do you have for this system?

A provider develops or places the system on the market and carries the disclosure and marking duties. A deployer uses it under their own authority and carries the deepfake and emotion-recognition notice duties. Many teams are both for different systems; answer accordingly.

Is the system made available to people in the EU, or is its output used there?

Where your company is incorporated does not decide this. Where the people are does.

How this works, and what it does not cover

This is a decision tree over the transparency obligations, deliberately conservative: where an answer is ambiguous the obligation is shown rather than hidden. The expensive failure mode is being told something does not apply when it does.

Article 50 splits by role. Disclosure at the interaction boundary and content marking are provider duties; deepfake disclosure and emotion-recognition notice are deployer duties. Teams that are both see both, which is the honest default.

The controls listed under each obligation are what has to exist in the running system. They are not a legal interpretation of the text, and they are not a substitute for one.

Whether an obligation applies to your specific system is a question for counsel. This tool tells you what to build once that question is answered.

The high-risk question at the end is not part of the transparency regime. It is there because if the answer is yes, transparency is phase one of a much larger programme, and knowing that now is worth more than discovering it in eighteen months.
